Mutah marriage according to Fiqh Al Ahwat, Chapter Nikah
(marriage)
“Mutah Marriage is a well-known, valid, perfect, and correct
temporary marriage of Islam, which is performed without a witness in exchange
for the present dowry. In the time of the Messenger of Allah (peace and
blessings of Allah be upon him), no one is against it. In this condition, the
Holy Prophet (peace and blessings of Allah be upon him) passed away from this
world. And the Holy Prophet (peace and blessings of Allah be upon him) did not
make any change in the marriage contract. The change in Mutah Marriage took
place after the death of the Messenger of Allah (PBUH). The person who says
that the change in Mutah Marriage was due to the consensus of the Ummah, then
this is his biggest mistake because many elders of the Islamic Ummah have
provided proof of the contract of Mutah. The consensus of the Ummah in the true
sense is that which is completely devoid of any opposition. When a person in
authority has decreed a matter and no one has the strength to go against it due
to the fear of killing himself and his honor, then it is not called Consensus
of Ummah.”
“نکاح متعہ حاضر مہر کے عوض کسی گواہ کے بغیر منعقد ہونے والا دین
اسلام کا ایک مشہور، جائز، کامل اوردرست اور وقتی نکاح کا نام ہے ۔ رسول اللہ صلی اللہ
علیہ و آلہ وسلم کے زمانے میں عقد متعہ کے متحقق ہونے میں کوئی بھی اس کے برخلاف نہیں۔
اس حالت میں حضور اکرم علیہ الصلواۃ والسلام اس حالت میں دنیا سے رحلت فرما گئے۔ اور
آپ نے عقد متعہ میں کوئی رد و بدل نہیں کیا۔ عقد متعہ میں ردو بدل کی صورت حال رسول
اللہ صلی اللہ علیہ وآلہ وسلم کی رحلت کے بعد رونما ہوئی تھی۔ جو شخص یہ کہتا ہو کہ
مقد متعہ میں رد و بدل کی صورت حال اجماع امت سے پیدا ہوئی تھی تو یہ اُس کی سب سے
بڑی غلطی ہے کیونکہ بہت سے بزرگان اُمت اسلامیہ نے عقد متعہ کا ثبوت فراہم کیا ہے ۔
اجماع امت حقیقی معنوں میں وہ معتبر ہے جو کسی کے برخلاف ہونے سے بالکل خالی ہو۔ جب
کوئی صاحب اقتدار حاکم کسی معاملے کا حکم دے بیٹھا ہو اور کسی شخص کو بھی اپنے قتل
اور عزت کے خوف سے اس کے برخلاف چلنے کی قدرت نہ ہوئی ہو تو اس کا نام اجماع امت نہیں
ہے”

As premarital sex is becoming acceptable in the majority of
the world, and over half of Muslim youth might engage in premarital sex, it is
time for Muslims to accept that Mutah Marriage is a well-known, valid, perfect,
and correct temporary marriage of Islam. In the time of the Messenger of Allah
(peace and blessings of Allah be upon him), no one is against it. Mutah
Marriage was not abolished by the Holy Prophet (peace and blessings of Allah be
upon him), but instead by a Muslim leader. No one had the strength to go
against that Leader due to the fear of killing himself and his honor.
If Muslims legalize Mutah marriage then Muslim youth who
want to get into a relationship (Temporary Marriage) can do so. The majority of
Muslim youth can have relationships and they would be saved from sinning.
